Waiver & Photography Release

I am participating in fitness classes offered by SOTA Fitness during which I will receive information and instruction about fitness. I recognize that fitness classes require physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any fitness classes. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the class.

In consideration of being permitted to participate in the SOTA Fitness classes, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which might incur as a result of participating in the program.

SOTA Fitness is not responsible for any loss of my personal property.

In further consideration of being permitted to participate in the SOTA Fitness classes, I knowingly, voluntarily and expressively waive any claim I may have against SOTA Fitness or any of its instructors for injury or damages, known or unknown that I may sustain as a result of participating in the program.

I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue SOTA Fitness or its instructors for any injury or death caused by my voluntary participation in any fitness class under the instruction of a SOTA Fitness instructor.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

I hereby authorize SOTA Fitness to publish photographs taken of me during classes, and my name and likeness, for use in the SOTA Fitness print, online, and video-based marketing materials. I hereby release and hold SOTA Fitness from any reasonable expectation of privacy of confidentiality associated with the images specified above.
